Heres' what you do............go to the Circuit Court Clerk's office.......

In the Commonwealth of Virginia, the biological parents of an unmarried person who dies without a will are the heirs of his estate. You need to file for an "In Teste List of Heirs", which will then make you the legal heirs, executors, etc., so that you and your wife can take care of your son's affairs.

The Clerk's office will guide you through the process.

I called one of my fellow Rotary buddies, who recently retired as Clerk of the Augusta Co. Circuit Court and he gave me that info. Good luck, my Hokie friend, and my sincere condolences.
